Sunnyvale BMR Requirements in Rental Projects
The City of Sunnyvale is processing significant changes in the Inclusionary Requirement on all rental projects over 6 units. Proposed rental inclusionary base requirements would force the builder to deed restrict at least 15% of units as affordable, subdivided as 10% low income and 5% very low income households. In-lieu fees would jump from currently $19.20 per sq. ft. to $30.00 per sq. ft. However, a developer in-lieu fee option would only be available if the City Council approves of the alternate mitigation request. All other mitigation options such as land dedication, partnering with a nonprofit builder, or rehabilitating dilapidated units would likewise be subject to the City Council’s discretion. The Housing Commission hearing on the proposed ordinance and fee schedule is August 28 at 7:00 pm, West Conference Room, City Hall, 456 W. Olive Ave., Sunnyvale, CA 94086. The Sunnyvale Planning Commission is scheduled on September 9, 2019, and the City Council will hear the issue on September 24, 2019. To read the City’s Draft Ordinance click here.
