• Morgan Hill Adopts Inclusionary In Lieu Fees

  • At a October 17, 2018 meeting, the Morgan Hill City Council formally modified the City’s housing in-lieu fee from $12.92 per square foot of the total project (8% affordability) to housing in-lieu fees that will equate to the recently adopted 15% and 10% ownership Inclusionary Housing Policy as adopted on July 25, 2018. Fee levels were provided by Keyser Marsten Associates in a study that specifies an in-lieu fee of $19.70 per square foot for residential development outside of Downtown where there is a 15% Inclusionary Housing Requirement, $13.20 per square foot for ownership projects in the Downtown where there is a 10% Inclusionary Housing Requirement, $29.00 per square foot for rental residential development outside of Downtown where there is a 15% Inclusionary Housing Requirement, and $14.50 per square foot for rental projects in the Downtown where there is a 10% Inclusionary Housing Requirement. Along with the in lieu fees, Council adopted a BMR participation guide to help BMR homebuyers understand ownership and investment in below market rate units and provides for a minimum return on a homebuyer’s down payment.
