The City of Milpitas is set to adopt the final chapter of its inclusionary zoning and commercial linkage fee ordinance on Tuesday, March 5, 2019. City Council will hear the staff recommendations to charge in lieu fees on ownership housing at $33 per sq. ft., and rental housing at $20 per sq. ft. Commercial linkage fees are recommended in a range of $1 to $3 per sq. ft., escalating to $7 per sq. ft. in 3 years. Milpitas is following the path of many neighboring cities by disregarding their own nexus studies and taxing commercial a fraction of the maximum supported fees.
