• Fremont Unified School District Poised to Adopt Level III Developer Fees

  • Despite the November 8th voter approval of Proposition 51 School Construction Bonds, the Fremont Unified School District Board of Directors is expected to proceed with adoption of Level III fees at its next regular meeting on Wednesday December 14, 2016. The District’s consultant prepared a School Facilities Needs Analysis, dated April 8, 2016, (SFNA) that ostensibly justified Level II and Level III developer fees, and on May 20, 2016 the Board adopted Resolution No. 018-1516, New Fees on Residential Development Projects Pursuant to Government Code section 65995 - Level II, which adopted the SFNA and established the alternative Level II fee of $8.19 per square foot of residential construction. If the Board approves the Level III fees on December 14th, builders will be required to start paying the new figure of $16.38 per square foot commencing on December 15, 2016. CBIA attorneys Dan Lanferman and Matt Francois have prepared an updated pay-under-protest form letter for members to use in the event a school district imposes Level 3 fees click here.
