The California Judicial Council has significantly shortened the CEQA challenge tolling period during the COVID-19 pandemic crisis to Aug. 3, 2020. Under the original Emergency Rule 9, the statute of limitations was tolled until 90 days after the governor’s declaration of an emergency was lifted. Declarations of emergency typically last for years as they are often a prerequisite for federal funding.
