The City of Sunnyvale becomes the latest Silicon Valley jurisdiction to propose adopting AB 1505 provisions to its affordable housing program policies that would allow the City to require the inclusion of BMR units in rental residential projects. The City is seeking Planning Commission recommendations on the Draft Inclusionary Below Market Rate Rental Housing Ordinance requiring construction of a range of Low and Very Low Income units or possible payment of substantially higher in-lieu fees. If adopted, the ordinance would mandate City Council approval of a “BMR Plan” for alternative mitigation proposals such as payment of fees, offsite construction of BMR units, or dedication of land.
