• Appeal Court Lifts Level 3 Stay

  • CBIA General Counsel Nick Cammarota has informed us that the Court of Appeal is lifting the stay on the next step toward implementation of Level 3 school impact fees in California. Lifting the stay allows the State Allocation Board (SAB) to notify the clerks of both houses of the California legislature that it has triggered Level 3 fees. Click here to view the court document. CBIA maintains that no school district can implement Level 3 fees until the notice from the SAB is printed in the journals of both the Assembly and the Senate. That can happen as early as this week. So far, the stay has prevented the implementation of Level 3 fees for more than five months. With the election and the voters’ decision on Prop. 51 (which will pump $9 billion into the state’s school construction account) just eight days away, the landscape remains highly fluid.
